The Challenge

An experienced Delium client was acting for a Wife in a complex property settlement and spousal maintenance dispute. The level of the Husbands net worth was a significant issue in the claim.

A Delium case was created and was accessed concurrently by both the legal and accounting teams who were working collaboratively to establish the net worth of the Husband.

The Wife lived overseas in a different time zone and possessed thousands of documents relevant to her case. She needed to work closely with the accounting experts and legal team to draw conclusions and formulate her case.

The Wife’s case was progressing well when her Husband (who worked in the technology industry) sought an injunction challenging the Wife posting documents on a website – ‘Delium’.

Delium Strategy

The collaborative features of Delium were perfect for overcoming the geographic challenges of teams working in different places and time-zones.

The Wife was set up as User in Delium and had been working diligently on her case. Comments, questions and annotations where applied to documents by the accounting and legal teams. These documents were flagged for the Wife to review and return comment on overnight, significantly reducing the communication lag associated with overseas clients, witnesses or experts.

The Husbands attempt to derail the Wife’s case preparation needed to be strongly refuted. When the injunction was applied for Delium worked closely with the legal team, providing the necessary technical detail to respond forcefully.

It may seem ludicrous with the explosion of cloud-based litigation support technology today, that not so many years ago this type of challenge would even be made.

Security has always been an integral feature of Delium. We were always confident we could refute any suggestion that the evidence would be exposed to unauthorised users or susceptible to hackers.

Ultimately the injunction was refused – the Judge concluded that all necessary steps had been taken in Delium to reduce the risk of unauthorised access or disclosure.

Since this case, the security in Delium has continued to evolve in line with current technologies. The software has been the subject of numerous independent penetration tests and deployed meeting the strictest of government security requirements.
