Evidence Publication

Delium’s flexible approach restores the traditional ability of legal team members to control the flow of their evidence presentation to other trial participants. Published evidence can be presented open to a specific page, zoomed in to a region, or with highlighted portions. However, Delium delivers a significant advantage to participants once evidence is published. Having received the published evidence, participants can work with the entire document independently of other participants, just as they would if handed a complete paper copy.

Delium supports publishing evidence:

  • publicly to the screens of all trial participants
  • privately to the screens of a sub-section of the trial participants, like the Judge and opposing Counsel during a voir-dere argument, or
  • privately to the screen of a member of your legal team to check the validity of a document.
  • Alternatively, an independent 3rd party operator can drive the process on behalf of the legal teams

Private Evidence

Every participant in a hearing comes with a unique perspective and understanding of the evidence to be presented. However, first and second-generation evidence presentation technology, such as slave screen or share screen tools, delivers a genericized experience that does not support traditional workflows or the participants’ requirement for ongoing analysis.

The flexible approach of Delium restores the traditional ability of legal team members and the judiciary by simultaneously displaying the evidence and publicly available meta-data alongside any private analysis or notes a participant has prepared in the lead up to hearings. This removes the requirement for them to independently search for and retrieve private analysis as a witness is being examined. Further private analysis and notes can also be added during hearings. This analysis can be private to the user or shared between members of a legal team.

The Whole Document in Your Hands

First-generation evidence presentation technologies easily and speedily display ‘callouts’ of the relevant parts of a particular document. However, this presentation style fails to efficiently present the whole document in the context of the specific passage displayed. As a result, without individual and duplicative efforts to read and understand the entire document, trial participants may fail to comprehend the true significance of the callout, particularly a witness.

While Delium supports callouts and zooming to a particular document portion, importantly, Delium publication still puts the whole document in a trial participant’s hands. Delium supports a trial participant’s ability to independently page forward and back, zoom, rotate, compare, annotate and analyse the whole document, not just a presented passage.

uploaded and is available ahead of witness examination.

The Judge or Arbitrators Perspective

In a traditional trial or arbitration, Judges and Arbitrators are not usually provided with access to a system to specifically record their trial analysis. Instead, they must rely on a range of private and disparate systems. In a Delium eTrial, the Judge or Arbitrator and their team have access to the same features as the legal practitioners. However, for the Judge or Arbitrator, there are additional benefits.

 Delium automatically creates a comprehensive evidence management record as a by-product of using Delium in the Trial. This automated record greatly enhances the Judge or Arbitrators capacity to review the Trial’s or Arbitration’s events when formulating judgment or arbitral determination. 

 

This comprehensive evidence management record includes:

 

  • A comprehensive list of the evidence presented to a witness, including the Document ID and exact focus point within a page, including any zooming or highlighting. 
  • Who presented the evidence to the witness, including the date and exact time.
  • A list of all participants who simultaneously viewed the evidence shown to the witness.
  • A  comprehensive Exhibit list.
  • Transcript automatically linked to the exhibits which can be viewed and read side by side.

Delium provides an extended capacity to manage the status of evidence, with the ability to record objections and apply limits to the admission of exhibits, both by category and with a narrative.

 

The Judge or Arbitrator can interact with the legal practitioners and the evidence replicating the controls and processes of evidence presentation in face-to-face trials or arbitrations as follows:

  • Documents can be passed directly and privately between practitioners and the Judge or Arbitrator.

Publication Lists

Witness examination and submission document lists can be securely prepared in advance, without disclosure to the opposing party. This ensures the required evidence is immediately available to be presented without the need for search while the trial is underway.
